General Terms and Conditions for Companies

These General Terms and Conditions ("Terms") govern all contracts between Go Ausbildung and business customers using employer services on the platform, including job posting, applicant management, and related recruiting tools.

1. Contracting Parties and Scope
   1. These Terms apply to all contracts between Go Ausbildung (Mohamed Abdelbacit Adous, Hauptsmoorstr. 12, 96052 Bamberg) and the customer.
   2. Commercial services are offered exclusively to entrepreneurs, merchants, and legal entities under private or public law.
   3. Conflicting customer terms do not apply unless Go Ausbildung expressly agrees in writing.
2. Subject Matter of Contract
   1. The specific service scope is determined by the order confirmation and referenced booking documents.
   2. Go Ausbildung may provide technical tools to create, publish, and manage job advertisements and applications.
3. Conclusion of Contract
   1. A contract may be concluded online, by email, by signed order form, or via other agreed channels.
   2. The contract becomes binding once Go Ausbildung accepts the order (e.g., by confirmation or beginning performance).
   3. If the customer submits modified order content, this is treated as a new offer requiring separate acceptance.
4. Employer Account and Verification
   1. Customers may create an employer account to manage job ads and applicants.
   2. Go Ausbildung may verify company authenticity and legal identity before granting full use.
   3. During verification, visibility of incoming applications may be temporarily restricted.
   4. If verification fails, Go Ausbildung may remove listings and related applications where legally permitted.
5. Customer Obligations
   1. The customer must provide complete, accurate, and up-to-date information.
   2. The customer is solely responsible for all published content, especially legal compliance of job postings.
   3. The platform may not be used for unlawful, discriminatory, misleading, abusive, or non-contractual purposes.
   4. Mass advertising emails, spam, and unauthorized automated communication are prohibited.
6. Prices, Billing, and Payment
   1. Prices are based on the agreed order confirmation and are net plus statutory VAT unless stated otherwise.
   2. Invoices are due within the payment period shown on the invoice.
   3. In case of payment default, statutory default interest and legally permissible collection costs may apply.
7. Contract Term and Termination
   1. Contract term and renewal conditions follow the selected package or individual agreement.
   2. Both parties retain the right to terminate for good cause.
   3. After termination, access to booked services may end immediately unless otherwise agreed.
8. Service Availability and Modifications
   1. Go Ausbildung aims to provide stable service but does not guarantee uninterrupted availability at all times.
   2. Temporary restrictions may occur due to maintenance, security measures, updates, or technical issues.
   3. Go Ausbildung may modify features where reasonable and required by legal, technical, or business needs, while preserving core contractual value.
9. Intellectual Property
   1. All rights to the platform, software, databases, and associated content remain with Go Ausbildung and its licensors.
   2. The customer receives a non-exclusive, non-transferable right to use services only within the agreed contractual purpose.
10. Data Protection
    1. Personal data is processed according to applicable data protection laws, including GDPR where relevant.
    2. Where required, specific data protection agreements and/or joint-controller arrangements may apply.
    3. The customer is responsible for lawful handling of candidate data within its own processes.
11. Warranty and Liability
    1. Go Ausbildung is fully liable for intent, gross negligence, and damages resulting from injury to life, body, or health.
    2. For slight negligence, liability is limited to breaches of essential contractual obligations and foreseeable typical damages.
    3. Mandatory statutory liability remains unaffected.
12. Indemnification
    1. The customer shall indemnify Go Ausbildung against third-party claims resulting from unlawful or contractual non-compliant customer content or use.
13. Changes to These Terms
    1. Go Ausbildung may amend these Terms where reasonable and necessary (e.g., legal, technical, or product-related changes).
    2. Customers will be informed in an appropriate manner before changes take effect, unless immediate changes are legally required.
14. Applicable Law and Jurisdiction
    1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory law requires otherwise.
    2. If legally permissible, place of jurisdiction is the registered seat of Go Ausbildung.
15. Final Provisions
    1. If any provision of these Terms is invalid, the validity of remaining provisions is unaffected.
    2. Individual written agreements prevail over these Terms for the specifically regulated matters.
